Preamble
These terms of use define the rules applicable to the use of the city+plus website and its services, operated by ParisBouge.
By creating an account, accessing the member area, or using all or part of the services offered on city+plus, the user acknowledges having read these terms of use and accepts them without reservation.
The member area of city+plus is accessible to persons aged at least 16. Users aged 16 or 17 must have obtained the prior authorization of their legal representative. ParisBouge reserves the right to request proof of such authorization at any time.
Article 1. Definitions
For the purposes of these terms of use:

Article 2. Access to the website and registration
Access to the website requires compatible equipment, an internet connection and, where applicable, the necessary software. All costs relating to access to and use of the website remain the responsibility of the user.
To create an account, the Member must provide accurate, complete and up-to-date information. The Member undertakes to update such information in the event of any change.
Each Member has personal and confidential login credentials. It is the Member's responsibility to keep them secure and confidential. Any use of the account made through such credentials shall be deemed to have been carried out by the relevant Member, unless proven otherwise.
The Member undertakes to inform ParisBouge without delay of any unauthorized use of the account or any breach of the confidentiality of the login credentials.
ParisBouge reserves the right to suspend, restrict or delete any account containing inaccurate, incomplete or misleading information, or any account used in breach of these terms or in an abusive manner.
ParisBouge also reserves the right to delete inactive accounts after a prolonged period of non-use.
Article 3. Use of the website and services
The Member undertakes to use city+plus in compliance with applicable laws and regulations, third-party rights and these terms of use.
In this respect, the Member is prohibited in particular from:
- using the website for unlawful, fraudulent, misleading or harmful purposes
- using the website for unauthorized commercial solicitation, spam, canvassing or abusive exploitation of the community
- publishing, transmitting or disseminating false, misleading, defamatory, insulting, obscene, violent, hateful, discriminatory content or content contrary to public policy or accepted standards of decency
- infringing intellectual property rights, image rights, privacy rights or any other rights of third parties
- publishing or transmitting any content containing viruses, malicious scripts, automated mechanisms, mass messaging or any other element likely to disrupt the operation of the website or the services
- circumventing security measures, accessing the website's systems without authorization or disrupting their operation
Content published by the Member, including texts, images, photographs, videos, links or other information, must be lawful, decent and consistent with the purpose of the website.
The Member is solely responsible for all content distributed through the user profile, including biography, profile picture, visuals, descriptions, links, messages, as well as any information or content published from the account.
ParisBouge reserves the right, at any time, without prior notice, without specific justification and without compensation, to delete, delist, make inaccessible, modify, refuse to publish or retain any content, to modify certain elements of a profile's presentation, or to suspend, restrict or remove access to all or part of the services.
The Member acknowledges that ParisBouge acts as a hosting provider or publisher depending on the relevant features and may take any useful moderation, verification, restriction, removal, filtering, blocking or deletion measure in order to ensure the security of the website, compliance with applicable laws, the protection of users, its own interests and the quality of the service.
ParisBouge makes its best efforts to moderate content published by users. However, given the volume of content likely to be published and the nature of the services offered, ParisBouge cannot guarantee prior, exhaustive or immediate review of all content made available online.
ParisBouge is under no general obligation to monitor content, information transmitted or stored, nor under any general obligation to seek facts or circumstances revealing unlawful activities.
Article 4. Personal data
Use of city+plus may involve the collection and processing of personal data.

Article 5. Intellectual property
The elements specific to city+plus, including texts, logos, icons, graphic elements, databases, software, website structure and associated services, are protected by intellectual property law.
Unless otherwise stated, these elements are the property of ParisBouge or are used under a valid right of use.
Any reproduction, representation, adaptation, translation, modification, distribution or exploitation, in whole or in part, of all or part of the website or its elements, by any means whatsoever, without prior written authorization, is prohibited unless otherwise provided by law.
The Member remains the owner of the rights in the content published by the Member, subject to the rights granted to ParisBouge under these terms.
By publishing content on city+plus, the Member grants ParisBouge, free of charge, worldwide and for the full duration of the protection of the relevant rights, a non-exclusive licence, irrevocable for the duration of exploitation of content already disseminated, transferable to companies within its group and sub-licensable to its technical service providers, partners, affiliates and successors, allowing it to host, store, reproduce, represent, communicate to the public, make available, adapt, translate, reformat, modify, distribute and exploit such content on city+plus, on its applications, on its communication media, newsletters, social networks, promotional campaigns and more generally in connection with the operation, improvement, promotion, communication and commercialization of its services.
This licence includes the right to make any technical, editorial, graphic or functional adaptations necessary for publication, indexing, referencing, archiving, retention, compatibility with various media, formats and devices, as well as for the promotion of the website and the services.
The Member warrants that the Member holds all rights and authorizations necessary for the content uploaded, including where such content depicts third parties or includes protected elements.
The Member shall indemnify and hold ParisBouge harmless against any claim, action, proceeding or decision of any kind resulting from the uploading, dissemination or exploitation of content provided by the Member, or more generally from any breach by the Member of these terms of use.
Article 6. Termination and account deletion
The Member may delete the account at any time, in particular through the account settings where such functionality is available.
In the event of a breach of these terms of use, or more generally in the event of conduct deemed incompatible with the proper functioning of the website, the security of the services, the interests of ParisBouge or those of other users, ParisBouge reserves the right, without prejudice to any other action, to suspend, restrict or remove all or part of the Member's access to the services, temporarily or permanently, with or without prior notice, without refund or compensation.
Suspension or deletion of the account may result in the removal of access to certain content, services or information linked to the relevant account.
ParisBouge also reserves the right to retain, for the period necessary to comply with its legal obligations, defend its rights or manage disputes, elements relating to a suspended or deleted account.
In the event of a breach of these terms, infringement of third-party rights, or fraudulent or unlawful use of the service, ParisBouge also reserves the right to take any appropriate action against the relevant Member, including legal proceedings or compensation claims aimed at obtaining redress for the loss suffered.
Article 7. Liability
Information and content published by Members are published under their sole responsibility. ParisBouge does not guarantee the accuracy, reliability or quality of content provided by users or third parties.
ParisBouge is not responsible for interactions between Members, nor for any consequences arising from meetings, exchanges, bookings, purchases or connections made through the website or as a result of its use. Users are responsible for acting with caution and discernment in their exchanges and in any relationship established through the website.
The website may contain links to third-party websites, services or content. ParisBouge exercises no control over such third-party services and shall not be held responsible for their availability, content, contractual terms or practices.
ParisBouge makes reasonable efforts to provide access to the website under reasonable conditions of availability and security, but does not guarantee uninterrupted, error-free, interruption-free, vulnerability-free or fully secure operation.
Accordingly, except where mandatory law provides otherwise, ParisBouge shall not be held liable for indirect damage, data loss, loss of business, loss of opportunity, loss of revenue, loss of customers, damage to image, non-material loss or any consequences resulting from the use of or inability to use the website or the services.
Article 8. Third-party services
city+plus may offer the integration or use of third-party services, including authentication, multimedia playback, streaming, mapping, analytics or booking services.
The activation or use of such services may involve the transmission of certain data to third parties. In such cases, the use of those third-party services is also governed by their own terms of use, privacy policies and data processing rules.
It is the user's responsibility to review such documents before using the relevant services.
Article 9. Event pages and venue pages
city+plus lists event pages and venue pages, which may be created, populated or enriched in several ways.
9.1 Event pages
Events may be published online by promoters, organizers or professionals through the forms made available to them in the professional area.
Professionals publishing an event are solely responsible for the information they put online, including dates, times, venues, descriptions, prices, booking links, access conditions and, more generally, any information relating to the event.
They are also solely responsible for the visuals, photographs, posters, videos or other media content published from their user account. They undertake to publish only content for which they hold all necessary rights, authorizations and licences, and to credit authors, photographers, rights holders or other rightsholders where applicable.
Events may also be created or enriched through automated processes importing event catalogues from ticketing or distribution partners, including Fnac Spectacles, Ticketmaster, See Tickets or Billet Réduc, this list being non-exhaustive.
ParisBouge does not guarantee the accuracy, completeness or currency of information resulting from such automated imports. Organizers, partners and users remain responsible for verifying useful information before making any booking, travelling or attending.
9.2 Venue pages
Venue pages may be created or managed by the company operating the relevant establishment, or by any company or person representing it, through the forms made available in the professional area.
Venue pages may also be created automatically when a user adds a venue to the saved venues list from the user account. In such case, a page may be generated automatically from data provided by the Google Business API, including, where available: name, address, category, contact telephone number, website address, booking link and opening hours.
ParisBouge does not guarantee the accuracy, completeness or currency of information resulting from such automatic sources or third-party services.
The owner of an establishment, its operator or any duly authorized person may request to recover the administration rights of an automatically created venue page in order to complete or modify the displayed information and add photographs or other content relating to the establishment.
The administrator of a venue page is solely responsible for the information put online, as well as for visuals, photographs or other content published from the account. The administrator undertakes to publish only content for which all necessary rights, authorizations and licences are held, and to credit authors, photographers, rights holders or other rightsholders where applicable.
ParisBouge reserves the right to create, merge, correct, complete, suspend, remove or reassign the administration of an event page or venue page, including in the event of duplicates, manifest error, legitimate claim, rights dispute, prolonged inactivity or failure to comply with these terms of use.
Article 10. Affiliate links
city+plus may offer affiliate links to third-party websites, including websites for booking shows, cultural activities or outings.
When a user clicks on an affiliate link and then makes a booking or purchase on a third-party website, ParisBouge may receive a commission, without affecting the price paid by the user unless otherwise stated.
Bookings, purchases and services carried out through such third-party websites are governed exclusively by the general terms, commercial policies and privacy policies of those partners.
Article 11. Modification of the terms of use
ParisBouge reserves the right to modify these terms of use at any time, in particular to reflect changes to the website, the services, applicable regulations or practices.
The version in force is the one published on the website on the date it is consulted. Continued use of the website after an update of the terms shall constitute acceptance of the new version.
Article 12. Applicable law and competent jurisdiction
These terms of use are governed by French law.
Subject to any mandatory legal provisions to the contrary, any dispute relating to their validity, interpretation, performance or consequences shall fall within the jurisdiction of the competent French courts.
